1) About these Terms
These Terms of Service (the “Terms”) govern your use of Shifted.Fitness provided by Shifted.Labs Ltd (“we”, “us”). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
2) Eligibility
You must be at least 16 in the UK/EEA (or the age of digital consent in your country) and at least 13 elsewhere. If you are under 18, you confirm that you have parental/guardian permission. The Services are not intended for children.
3) Medical & safety disclaimer (very important)
Shifted.Fitness provides fitness and nutrition guidance for general informational purposes only. We are not a medical organisation and do not provide medical advice, diagnosis, or treatment. Our Services and AI‑generated content are not a substitute for professional medical advice. Always consult a qualified healthcare professional before starting a new programme, especially if you are pregnant, nursing, have a medical condition, or are recovering from injury. Stop any activity that causes pain, dizziness, or shortness of breath and seek professional advice. We do not guarantee specific results; outcomes vary by individual.
4) Your account and security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorised use. We may suspend or terminate accounts that violate these Terms or our policies.
5) Licence and acceptable use
We grant you a limited, personal, revocable, non‑transferable, non‑exclusive licence to use the Services for your own fitness and wellness purposes. You agree not to: reverse engineer, copy, or create derivative works from the Services; bypass security measures or access data you are not authorised to access; upload unlawful, infringing, or harmful content; use the Services to train competing models or datasets; or use the Services in a way that violates applicable law.
6) User content and permissions
You retain ownership of your content (e.g., short training videos/photos). You grant us a worldwide, royalty‑free licence to host, process, and display your content solely to provide and improve the Services. Where you submit reviews, feedback, or suggestions, you grant us a licence to use them to improve the Services without obligation to compensate you. We may remove content that violates these Terms or the law.
7) AI features
Our Services may use AI to generate responses, summaries, or guidance based on your inputs and profile context. AI outputs may be inaccurate or incomplete. Always exercise judgement and, for health questions, consult a professional. Where offered by our AI providers, we configure settings to limit the use of your data for model training.
8) Third‑party services
The Services may use or link to third‑party services (e.g., app stores, hosting providers, analytics, media hosting, AI processing). Those services are governed by their own terms and privacy practices, which we do not control. If you purchase through an app store, billing, cancellations, and refunds are managed by that store’s terms and policies.
9) Changes, availability, and support
We may modify, suspend, or discontinue any feature on reasonable notice where feasible. We aim to keep the Services available but do not guarantee uninterrupted access. Support is available via hello@shifted.fitness.
10) Fees and subscriptions
If we introduce paid features or subscriptions, pricing and terms will be presented in‑app or by the app store before purchase. Auto‑renewal terms and cancellation methods will be clearly stated. Your statutory consumer rights remain unaffected.

11) Intellectual property
We and our licensors own all rights in the Services, including software, designs, text, graphics, and trademarks. Except for the limited licence in Section 5, no rights are granted to you.
12) Termination
You may stop using the Services at any time and may request account deletion. We may suspend or terminate access if you materially breach these Terms or use the Services unlawfully. Upon termination, your licence ends and Sections intended to survive (e.g., disclaimers, limitation of liability) remain in effect.
13) Disclaimers
The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy, and non‑infringement. We do not warrant that the Services will be error‑free or uninterrupted.
14) Limitation of liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including for death or personal injury caused by negligence, or for fraud. To the fullest extent permitted by law, we will not be liable for: (a) indirect or consequential losses; (b) loss of profits or data; or (c) damages exceeding the greater of £100 or the amounts you paid to us in the 12 months before the event giving rise to the claim. Your statutory consumer rights are not affected.

15) Indemnity (non‑consumer use)
If you use the Services for business purposes, you agree to indemnify and hold us harmless from claims, damages, or costs arising from your unlawful use or breach of these Terms.

16) Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, except that consumers residing in the EEA/UK may benefit from mandatory local consumer protections and may bring claims in their local courts.

17) Changes to these Terms
We may update these Terms from time to time. Material changes will be notified in‑app or by email where appropriate. Continued use after changes take effect constitutes acceptance.
